The legal system is complex and for those individuals who find themselves in court for the first time, deciding how to manage the experience is critical. Some courts are structured to be more user friendly for individuals and businesses. For example, the small claims court in Florida is designed to be the “People’s Court“, and people can represent themselves, or what the legal world calls appearing “Pro Se”. However, lawyers as well, can appear in small claims court and represent a client.
As a result, my experience has been that the Pro Se party is at a disadvantage when facing an attorney on the other side. However, with proper instruction, preparation and an understanding of the applicable rules, a Pro Se party may be able to level the playing field, if they choose to handle the case without an attorney representing them. However, that choice must be their own, after evaluating their ability to properly present, learn the rules and evaluate and accept the risks, if not successful.
