What is Wage Theft?
Wage theft occurs when an employer does not pay his or her employee the wages or benefits that they are legally entitled to receive.
The following are just some examples when Wage theft occurs:
- The Employer fails to pay 1 and 1/2 times the regular pay rate after 40 hours of work in a week
- The Employer pays less than the minimum wage
- The Employer requires the Employee to work off the books
- The Employer fails to give his or her Employee a final paycheck
- The Employer steals some or all of the Employee’s tips
- The Employer falsifies records of the hours worked by employee
- The Employer incorrectly classifies an Employee as an ‘independent contractor’
The U.S. Department of Labor has identified Florida as a state with a very serious “Wage Theft” problem.
